NO PURCHASE IS NECESSARY TO ENTER OR WIN A PRIZE DURING THE GIVEAWAY. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

 

 

1. Who Can Enter | Eligibility

Dr. Renee Carr The Problem Solver’s RACIAL EQUITY & SOLUTIONS Subscriber Giveaway (“Giveaway”) is open only to persons who are 18 years of age or older on the date of entry. The Giveaway is only open to legal residents of the United States of America and is void where prohibited by law.

 

By participating, you agree to be bound by the Official Rules (“Rules), and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Dr. Renee Carr The Problem Solver as final and binding as it relates to the content. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. 

 

2. How to Enter | Entry Requirements

Your entry must fulfill all Giveaway requirements, as specified throughout these Rules, to be eligible to win a prize. To enter the Giveaway, each initial entry must complete each of the following online steps. Online entry via a valid email address is the only method of entry. Each person who enters the Giveaway becomes an Entrant.

• Step 2: Subscribe to the Dr. Renee Carr The Problem Solver YouTube channel by clicking here.

• Bonus Entry: If desired, you can complete extra challenges to get more entries.

 

Entries that are not complete or do not adhere to the Rules, steps, or specifications may be disqualified at the sole discretion of Dr. Renee Carr The Problem Solver. You may not enter more times than indicated by using multiple email addresses, social media accounts, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Dr. Renee Carr The Problem Solver.

 

Entries must comply with YouTube’s Community Guidelines (available here) and Terms of Services (available here) (collectively the “YouTube Terms”). Entries that do not comply with the YouTube Terms, or are incomplete, false, or deceptive are void. Entries must be in English and shall not contain any elements that violate a third party’s copyrights, trademark rights, or personal, privacy, or other rights of any kind. Without limitation, entries should not depict, tag, or reference any individuals that have not granted permission to be featured and be bound by these Official Rules.

 

3. Giveaway Duration

The Giveaway begins at 8:00pm EST on 9/12/2020 and ends at 11:59pm EST on 9/30/2020.  All entries will begin when the YouTube video is published as “Public” and entries must be received by 11:59pm EST on the last day. Dr. Renee Carr The Problem Solver will close the Giveaway once completed.

 

4. Selection of Winners

Winners of the Giveaway will be selected on Friday, 10/2/2020 by 5:00pm EST and will be posted on YouTube no later than Monday, 10/5/2020 by 5:00pm EST. Winners will be selected in a random drawing under the supervision of Dr. Renee Carr The Problem Solver. Winners will be notified via the email address provided while completing the AM I RACIST? symptom survey. Dr. Renee Carr The Problem Solver shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail, or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within three days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize may be forfeited and an alternate winner selected. The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (At Dr. Renee Carr The Problem Solver’s sole discretion) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED. 

 

If an alternate winner is chosen, the alternate winner will be contacted via email as soon as practicable and shall also have three days to respond. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED (WHICH MAY REQUIRE ENTRANT’S EXECUTION AND RETURN OF AN AFFIDAVIT OF ELIGIBILITY, A LIABILITY RELEASE, AND/OR A PUBLICITY RELEASE CONSISTENT WITH THE TERMS HEREIN AND AS DETERMINED IN Dr. Renee Carr The Problem Solver’s SOLE DISCRETION), AND THE ALTERNATE WINNER HAS BEEN NOTIFIED VERIFICATION IS COMPLETE. 

 

By entering this Giveaway, you accept and agree to these Official Rules and the decisions of Dr. Renee Carr The Problem Solver, which shall be final in all matters. Except where prohibited by law, by entering into this Giveaway and/or accepting the Prize, each winner hereby irrevocably grants to Dr. Renee Carr The Problem Solver, the worldwide, royalty-free right and license to print, publish, broadcast, distribute, and use the winner’s name, social media handle, photograph, likeness, and statements for promotional or advertising purposes in connection with this Giveaway on a worldwide, in perpetuity basis, and in all forms of media, now or hereafter known, in perpetuity, without review, permission, or further compensation or consideration. 

 

Odds of winning a Prize (defined below) depend on the number of eligible entries received from Entrants during the Giveaway Duration.

 

5. Prizes

Each of the winners will receive a $25 USD or a $50 USD gift card to Starbucks, Panera Bread, or Dunkin Donuts; or a $150 USD cash prize (debit card).

If the Dr. Renee Carr The Problem Solver’s YouTube reaches 100 subscribers, 5 subscribers will win a $25 gift card. If the Dr. Renee Carr The Problem Solver’s YouTube page reaches 1000 subscribers, 10 subscribers will win a $25 gift card, 5 subscribers will win a $50 gift card, and 1 subscriber will win a $150 cash debit card. Each winner is solely responsible for any costs or expenses associated with or resulting from acceptance of a Prize. 

 

Winners will be notified of and will receive the prize(s) via the email account provided upon completing the AM I RACIST? symptom survey. The specifics of the prize shall be solely determined by Dr. Renee Carr The Problem Solver. No cash or other prize substitution permitted except at Dr. Renee Carr The Problem Solver’s discretion. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for Dr. Renee Carr The Problem Solver to use the winner’s name, social media handle, pictures, likeness, statements, and entry for purposes of advertising and promotion without further compensation, unless prohibited by law.
 

Limit 1 Prize per family or household per Giveaway Duration. Additional restrictions may apply.

 

6. Odds of Winning

The odds of winning depend on the number of eligible entries received in the Giveaway. Bonus entries are permitted for select Giveaways and must be completed by the end of the Giveaway Duration date.

 

7. Specific Conditions

Any incomplete or illegible entries will not be processed. The use of automatic, robotic, macro, and/or pre-programmed entries is strictly prohibited. Any attempt by any participant to obtain more than the stated number of entries by using multiple or different social media accounts, email addresses, identities, registrations and logins, or any other methods may void that participant’s entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Dr. Renee Carr The Problem Solver is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entry applications, which will be disqualified.

 

In the event of a dispute as to any entry application, the authorized account holder of the social media account or email address used to register for the Giveaway will be deemed to be the Entrant.

 

8. Specific Terms of Giveaway

Dr. Renee Carr The Problem Solver reserves the right, in its sole discretion to cancel, terminate, modify, or suspend the Giveaway should (in its sole discretion) a virus, malware, non-authorized human intervention, fraud or other causes beyond its control, corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such a case, Dr. Renee Carr The Problem Solver may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Dr. Renee Carr The Problem Solver. Dr. Renee Carr The Problem Solver reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Terms & Conditions or Rules. Dr. Renee Carr The Problem Solver has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to multiple entries from the same user from different IP addresses or from different social media accounts, multiple entries from the same computer in excess of that allowed by Giveaway rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made, Dr. Renee Carr The Problem Solver reserves the right to seek damages from any such person to the fullest extent permitted by law.

 

By entering the Giveaway you agree to receive email updates periodically from Dr. Renee Carr The Problem Solver. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the email.

 

9. Limitation of Liability | Released Parties

By participating in the Giveaway, you agree to be fully and unconditionally bound by these Official Rules and the decisions of Dr. Renee Carr The Problem Solver and waive any and all right to claim ambiguity in the Giveaway or these Rules or that your publicity or similar rights were infringed upon.

 

By entering the Giveaway, you agree to release and hold harmless Dr. Renee Carr The Problem Solver and its advertising and promotion agencies, partners, representatives, agents, or employees; YouTube, Twitter, and each of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) from and against any claims, damages, disability, attorneys’ fees, and costs of litigation and settlement, as well as any liability due to illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the Giveaway and/or your acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) lost, late, misdirected, undeliverable or incomplete entries due to system errors or failure, or faulty transmissions or other telecommunications malfunctions and/or entries; (iii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iv) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (v) unauthorized human intervention in any part of the entry process or the Giveaway; (vi) electronic or human error which may occur in the administration of the Giveaway or the processing of entries. 

 

If for any reason an Entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is another entry in the Giveaway.

 

10. YouTube and FTC Release

In no way is this Giveaway endorsed, associated with, sponsored by, or administered by YouTube or any social media platform it is promoted on.

 

11. Disputes

THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF DELAWARE, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, you agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Delaware having jurisdiction. Should there be a conflict between the laws of the State of Delaware and any other laws, the conflict will be resolved in favor of the laws of the State of Delaware.  

 

Further, in any such dispute, under no circumstances will an Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorney fees, other than Entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Giveaway), and Entrant further waives all rights to have damages multiplied or increased. 

 

12. Privacy Policy

Information submitted with an entry is subject to the Privacy Policy stated on Dr. Renee Carr The Problem Solver’s Website. To read the Privacy Policy, click in the footer on any page of the website, www.TheProblemSolver.co.

 

By entering this Giveaway, you acknowledge and agree to opt-in to the Privacy Policy. You further acknowledge that if you are chosen as a winner, that certain identifying information including your social media handle, name, statements, and other identifying information may be disclosed to third parties as required by law including, without limitation, listing on a Winner’s List.

 

13. Winners List

For the social media handles of the Prize winners, please watch the YouTube Video on the date it’s announced pursuant to the schedule set forth above. To obtain a list of the winners’ social media handles or an electronic copy of these Official Rules, email your request to News@TheProblemSolver.co. In the subject line of the email, type “RACIAL EQUITY & SOLUTIONS Subscriber Giveaway.” Requests must be received no later than October 31, 2020.
